Occasionally a situation arises where there is an issue of possession of data. Sometimes domain ownership is in question or needing to be changed. The following article should hopefully help you find a resolution to these issues.
For the purposes of this article, the following is true:
Claimant – person or company making the claim.
Account Owner – person listed as the service or account owner in our system.
Cornerstone Media Group acknowledges the following two types of ownership issues:
- Domain Name ownership
- (CMG) account ownership
The following is a list of 3 possible scenarios:
- The Claimant does not own the domain and is not he Account Owner.
- The Claimant owns the domain but is not the Account Owner.
- The Account Owner was an employee of Claimant but is no longer employed.
- The Account Owner is a third party.
- The Claimant is the Account Owner but does not own the domain.
Under scenarios #1 and #3, the Claimant must follow the ICANN Uniform Dispute Resolution Policy. More information about this here;
http://www.icann.org/udrp/udrp.htm
Under scenario #2, if the Claimant can get the Account Owner to agree to the transfer, we require the necessary documentation per the transfer of account ownership document. See Account Transfer Letter With Account Owner Agreement.
Under scenario #2-a, if getting the transfer letter signed is not possible then Complainant will need to provide proof Account Owner was previously an employee. This would need to be done by providing a signed I-9 or W-3* and statement on letterhead that said employee existed, dates employed, and contact with said employee is not possible. See Account Transfer Letter, Account Owner is an Ex-Employee.
*If you are in a country other than the United States, you will need to provide employee tax documentation that proves the employee worked for your company.
An account transfer fee of $25.00 must be paid for administrative costs.
If Claimant can prove ownership of domain, but is not Account Owner, creation of a new account and directing of the domain to the new account is allowed.
If Claimant cannot prove ownership through the given methods, a lawyer or arbiter is recommended to resolve your dispute.
